ABOUT THIS DEBATE:

Multi-tiered dispute resolution clauses have become increasingly prevalent in commercial contracts. These often require parties to engage in a series of alternative dispute resolution (ADR) methods—such as negotiation, mediation, expert determination, adjudication, and/or dispute boards—before advancing to arbitration. These mechanisms are often designed with the intent to offer quicker, more flexible pathways to settlement, potentially avoiding lengthy litigation or arbitration. However, the layering of such processes introduces complexity in drafting and interpretation, frequently resulting in disputes over the enforceability of the clauses themselves. Do these clauses offer a meaningful opportunity for resolution, or do they merely delay the finality of disputes and add procedural hurdles?

Our panel of speakers comprising of arbitration counsel, experts and in-house counsel will explore whether multi-dispute resolution clauses expedite or hinder the finality of disputes.

OBJECTIVE OF THIS DEBATE:

SIArb’s mission includes the education of arbitration practitioners, the development of the arbitration profession and the promotion of arbitration more generally. Its mission also includes providing social and networking opportunities for all those involved in the Singapore arbitration industry, including younger practitioners.

Following the success of last year’s debate, we have again assembled a group of leading younger speakers to discuss an important area of practice. Whilst the debate is particularly aimed at younger practitioners, all are welcome to attend.

Toh Jia Yi – Co-Chair, Young Practitioners Network, SIArb; Partner, Allen & Gledhill LLP

Jia Yi is a Partner in Allen & Gledhill’s Intellectual Property, Litigation, International Arbitration, and Cybersecurity and Data Protection Practices. Jia Yi currently serves as a Council Member of the Singapore Institute of Arbitrators, and as a member of the International Chamber of Commerce (ICC) Singapore Arbitration Group Core Committee and Beihai Asia International Arbitration Centre (BAIAC) Committee. She is also an Accredited Mediator with the Singapore Mediation Centre. She is actively involved in the Law Society of Singapore as a founding member of the Women in Practice Committee.

 

Arias Lim Jie – Co-Chair of Young Practitioners Network, Singapore Institute of Arbitrators; Senior Associate, K&L Gates Straits Law

Arias Lim Jie is a Senior Associate at K&L Gates’ Singapore office. She handles a wide variety of commercial arbitrations, with an emphasis on energy disputes. She has acted in ICC, SIAC, LCIA and ad hoc arbitrations seated in Singapore, London, Paris, Zurich and Vienna. Arias also represents clients in arbitration-related court proceedings, including the setting aside and enforcement of arbitral awards, and making applications for stay of proceedings and interim injunctions.

Arias is qualified to practice law in Singapore and in England and Wales. She obtained her LLB from the National University of Singapore (2014) and graduated summa cum laude from Science Po's LLM in Transnational Arbitration and Dispute Resolution (2022). A native speaker of English and Mandarin, Arias also speaks French. Arias is also serving as an Executive Committee member of the Sciences Po Arbitration Society.

ABOUT THE MODERATOR:

 

Julian Lim – Senior Associate, Ashurst LLP

Julian is a senior associate at Ashurst.

He specialises in international dispute resolution, with a particular focus on international commercial arbitration.  He represents major clients across the energy, oil & gas, power, construction, engineering & infrastructure, technology, and financial services sectors.

Julian is currently based in Singapore.  Prior to that, he spent six years at Ashurst's London office advising on disputes relating to some of the most high-profile projects in Europe, the Middle East, Africa and the Asia-Pacific region.

Julian is qualified in England & Wales and is admitted to the roll of solicitors in Ireland.  He sits as a committee member of the Singapore Institute of Arbitrators' Young Practitioners Network and the AAA's International Centre for Dispute Resolution.  Julian is also an associate member of Practical Law's arbitration consultation board.

ABOUT THE DEBATERS:

 

Helen Wang – Partner, Carey Olsen

Helen Wang is a partner in leading offshore law firm Carey Olsen's litigation, insolvency and restructuring practice in Singapore. She specialises in complex commercial litigation, shareholder disputes, estate and private clients related disputes, fraud and investigatory cases and insolvency and restructuring matters. Helen has extensive experiences advising clients on cross-border litigation and handling high value disputes, covering a broad range of sectors, including financial services, energy and resources, insurance and high net-worth individuals. She has been listed as a Next Generation Partner in The Legal 500 Asia 2024 Guide. She has also been recognised as a Rising Star in China Business Law Journal's 2023-24 A-List of elite private practice lawyers in the Chinese market. She has also been named in the Asian Legal Business (ALB) Asia Super 50 Disputes Lawyers (2024), Offshore Client Choice List (2023 and 2024), Top 10 Offshore Litigators (2023 and 2024) and Asia 40 under 40 List (2023). Helen is admitted in Hong Kong (also as a solicitor advocate) and England & Wales. She is also admitted as a solicitor of the Eastern Caribbean Supreme Court (British Virgin Islands) and a registered Bermuda practitioner.

 

Oliver Watts – Partner, Osborne Partners

Oliver Watts is a Partner at Osborne Partners, and head of the Singapore Office. He is a chartered accountant and Chartered Financial Analyst.  Oliver specialises in assessing financial and valuation issues in contentious and non-contentious matters. He has broad experience in shares and business valuation including in shareholder and joint venture disputes, private equity investments and investment treaty claims. He has been appointed as an expert over 20 times in Court proceedings and international arbitrations in Singapore and internationally. He has testified before Courts and Tribunals on multiple occasions and is identified as a Future Leader in Who’s Who Legal’s latest list of arbitration expert witnesses.

 

Jennifer Lim – Independent Advocate, Duxton Hill Chambers

Jennifer Lim is an independent advocate at Duxton Hill Chambers (Singapore Group Practice). She focuses her practice on international dispute resolution and arbitration, representing clients in investor-state and commercial arbitrations seated in cities around the world. Jennifer also sits as arbitrator under SIAC and ICC rules. In addition, Jennifer advises on general transnational litigation matters, including arbitration-related court proceedings and complex cross-border disputes.

Since 2023, Jennifer has been recognised as a Who’s Who Legal (WWL) “Thought Leader – Global Elite: Arbitration Future Leader”, the highest accolade by the publication for outstanding lawyers aged 45 or under. She has also been selected as a WWL “International Arbitration Future Leader” since 2019 and “Southeast Asia Arbitration National Leader” since 2023.

Jennifer is qualified in New York, England & Wales, Singapore, and Hong Kong (non-practising), and she is bilingual in English and Mandarin Chinese.

 

Andrew Raymond – Partner, Watson Farley & Williams LLP

Andrew Raymond is a Partner in the Dispute Resolution Group at Watson Farley & Williams, Singapore. Prior to joining Watson Farley & Williams, Andrew worked in the London, Dubai, Tokyo and Seoul offices of a top global dispute resolution firm. He has experience representing a wide range of clients in all major forms of dispute resolution, including commercial litigation, mediation and international arbitration. Andrew regularly conducts advocacy in mediations and international arbitrations, where he has represented clients under the DIAC, HKIAC, ICC, JCAA, LCIA and SIAC rules. Andrew has particular experience in disputes arising from international construction projects in the energy sector.

ABOUT THE JUDGES:

Raja Bose – Partner, K&L Gates Straits Law

Raja Bose is a partner in K&L Gates’ Singapore office and leads the firm's international arbitration practice in Asia. He has 30 years of experience in international dispute resolution.

He has worked in both London and Singapore and is dual qualified in both jurisdictions. He is also a qualified arbitrator and is a Fellow of both the Chartered Institute of Arbitrators of the UK as well as of the Singapore Institute of Arbitrators. Raja is on the panel of arbitrators of a number of arbitration institutions in Singapore, Malaysia, Indonesia, Hong Kong, India, China, Vietnam, Dubai, Paris and London. He was also a former Director of the UK Chartered Institute of Arbitrators – Singapore Branch.

He is currently the chairperson and moderator of 2 programs on investor-state disputes and bilateral investment treaty arbitrations both of which he was instrumental in formulating, proposing, organizing, managing and executing: the first for Practicing Law Institute in New York (now into its 4th year) and the inaugural ISDS program for GAR Academy launched in 2024.

Raja splits his practice into 2 broad areas:

  • Public International Law advisory and disputes; advising host states on the drafting and negotiation of new bilateral investment treaties particularly in Africa; investment structuring for foreign investors to secure treaty protection and on investor-state arbitrations and foreign investment disputes brought under investment treaties; and
  • International commercial arbitration and mediation; acting as both lead counsel as well as sitting as an appointed arbitrator in commercial arbitrations with seats in Singapore, Hong Kong, Indonesia, Vietnam, China, India, Dubai, Malaysia, London, Paris, Geneva, California, Washington DC and New York under a variety of trade association and international arbitration centre rules.

Tian-Yi Tan – Senior Legal Counsel, Disputes and Government Investigations Legal, Standard Chartered Bank

Tian Yi is Senior Legal Counsel in the Disputes & Government Investigations Legal team at Standard Chartered Bank. She manages high-value and complex disputes, arbitration and significant regulatory investigations for the bank.

Prior to her in-house career, she worked in the litigation and international arbitration practice group of a Magic Circle firm, and acted for clients in arbitration proceedings under the major institutional rules, including the SIAC, ICC and LCIA Rules. She has deep experience advising parties in arbitration-related court proceedings and cross-border litigation. In 2021, she was commended in the Legal 500 directory for her skilled case management. Presently, she also volunteers with the Law Society of Singapore as a member of the Women in Practice Committee.

 

Ramesh Selvaraj – Partner, Allen & Gledhill LLP

Ramesh is the Deputy Head of Allen & Gledhill’s International Arbitration Practice. He is recommended for his expertise in international arbitration and commercial litigation in leading publications, such as The Legal 500 Asia Pacific where he has been described as an “excellent attorney”, and as one who provides “cogent, timely answers”.  Ramesh currently serves as a Council Member of the Singapore Institute of Arbitrators and member of the Governing Council of the Madras Chamber of Commerce & Industry’s (MCCI) Arbitration, Mediation and Conciliation Centre. He also served as the Co-Chair of the YSIAC Committee from 2019 to 2020, formed under the auspices of the Singapore International Arbitration Centre.
