Event Synopsis
Over the last two decades, international commercial courts have burgeoned across the globe. However, there is wide divergence in their
features and objectives. The London-headquartered Standing International Forum of Commercial Courts (SIFoCC), whose 58-member
jurisdictions comprise 70% of G20 countries, was also established in 2017.


What precipitated this development? Are they the outcome of an intuitive response by State Courts to stay relevant, or instead, caused
by a need for improved mechanisms to facilitate global commerce? Is international commercial justice now being commoditised as caviar
justice for businesses and, if so, why? Are there other underlying reasons, such as asserting smart power on the regional or global stage?
Have creases in international commercial arbitration—like increasing costs, lengthy proceedings, ethical dilemmas, limited jurisdiction
for joinder, bounded precedential value, and restricted review—contributed to this development? Will these revamped State Courts
supplant international commercial arbitration tribunals, or will they coexist and complement each other? Are they competing or
collaborating with arbitration, as well as among themselves, for judicial work and thought leadership? Might coopetition undermine
traditional notions of judicial comity and introduce more uncertainty in the resolution of international commercial disputes?

Is the ‘arbitralisation’ of justice by international commercial courts and the ‘judicialisation’ of processes by commercial tribunals leading
towards a convergence of pathways to better resolve international commercial disputes? Could artificial intelligence accelerate this
convergence? These are some of the topical issues that this Lecture will explore.
