About the Seminar:
The talk will commence with a brief examination of the various participants in the oil and gas chain, the kind of contracts and governing laws in use, and the types of arbitration seen in the upstream, midstream and downstream parts of the chain. From his experience of arbitrations relating to the construction of midstream (extraction and processing) and downstream (refining) facilities, Shourav will then examine the issues that regularly arise in such arbitrations, relating both to substantive law (such as decision-making in joint ventures, ground and climatic conditions, delay and cost overrun, completion, warranty provisions, loss of production claims and limitation of liability) and arbitration procedure (such as multi-tier dispute resolution provisions, protective measures, disclosure requests and expert witness evidence).
The talk will close with a discussion of opportunities in this area for arbitration practitioners in Singapore, and will be followed by a Q&A session and interactive discussion with participants.

About the Speaker:
Shourav has been a disputes lawyer for over 20 years, and has practised in Singapore, Hong Kong, London, Dubai and Beijing. He is currently in independent practice as a locally-qualified lawyer in both Singapore and Hong Kong. Shourav primarily represents clients in international arbitrations relating to the construction of oil and gas and infrastructure projects. He has consistently been recommended by the directories as a leading lawyer in this area, with the forthcoming Chambers and Partners’ 2018 edition noting that Shourav has “good grasp of the law, particularly international arbitration law” and marking his “vast knowledge and experience in handling complex construction disputes." Shourav studied law at NUS on the Singapore Airlines scholarship, and has a postgraduate degree from Stanford, where he was a Sloan Fellow and President of his class. About the Chairperson:
Mr. Naresh Mahtani, FSIArb, FCIArb, has been in active legal practice for over 30 years, in dispute resolution and in regional and international construction and oil and gas projects in various cases in Singapore and the region. He was Chairman of the Society of Construction Law, Singapore (2006 – 2008) and is currently the Hon. Secretary and Course Director of the Singapore Institute of Arbitrators. He was a founding partner of ATMD Bird & Bird LLP; and is currently a partner with Eldan Law LLP, with an on-going active practice as arbitrator, adjudicator and mediator, as well as counsel and advisor for the resolution of disputes. He has a keen interest in “New ADR” for more efficient and progressive means of resolving disputes to be used in conjunction with more established procedures |
