About the Seminar:
Singapore has come a long way in establishing itself as a global arbitration hub. In a move designed to further enhance Singapore’s role in this area, Parliament introduced the Civil Law (Amendment) Bill 2016 (“Funding Bill“). The Funding Bill, which has just been passed, has introduced measures to allow for third party funding for international arbitration in Singapore. The Act and the accompanying Regulations are expected to be law by the time this seminar takes place. What are the implications of the new laws for arbitrators, arbitration counsel, arbitration institutions, the funders and the parties to the arbitration? What are their respective duties of all stakeholders?
Our distinguished panel shares insights from the work of SIArb, SIAC and the Law Society on guidelines which are being drafted to promote best practices in third party funding.

About the Panelists:
Mr. Dinesh Dhillon practises international arbitration and litigation. He has acted as lead counsel in international arbitration for global multinational corporations in the telecommunications, airline, hotel, commodities, construction, manufacturing and projects industries. Apart from corporates, he has also represented sovereign states in international arbitration cases. He has represented clients in landmark cases before the Singapore courts relating to jurisdiction of arbitral tribunals, challenges to arbitration awards and attempts to resist enforcement of foreign arbitration awards. Dinesh has represented multinational companies in cases before the Singapore High Court and Court of Appeal relating to banking, corporate, employment, entertainment, insurance, property and shareholder disputes. He has also acted for statutory boards in judicial review cases. Dinesh was called to the Singapore Bar in 1995. In 2004, he obtained the Graduate Certificate in International Arbitration from the National University of Singapore. He is recommended for his expertise in international arbitration and commercial litigation in leading publications, such as Chambers Global and The Legal 500 Asia Pacific where he has been described as “outstanding”, a “well respected litigator” and “strong on strategy and case management”. He is a Fellow and Vice President of The Singapore Institute of Arbitrators, Honorary Treasurer of the Law Society of Singapore, Honorary Treasurer of the Pro Bono Services Office and Co-Chair of the International Bar Association’s Asia Pacific Arbitration Group. |
As Registrar of SIAC, Ms. Delphine Ho oversees the SIAC Secretariat in the provision of case management services. Delphine joins the SIAC with both private and public sector experience. She has spent a significant part of her career with leading Singapore law firms where she specialised in civil and commercial litigation and arbitration. She subsequently joined the Singapore Legal Service and served as an Assistant Registrar of the Singapore Supreme Court. Delphine is called to the Singapore Bar and is also admitted as a solicitor in England & Wales. In addition, she is an Associate Mediator of the Singapore Mediation Centre. Delphine speaks English, Mandarin and French. |
Mr. Thio Shen Yi SC read law at St John’s College, Cambridge University, graduating in 1991. He subsequently topped the English Bar Examinations, and was called to the Singapore bar in 1993. Since then, he has practiced exclusively in dispute resolution, primarily as counsel, and occasionally as arbitrator. He was appointed Senior Counsel in 2008 at 40 and was elected a Master Bencher of The Middle Temple in 2016. Shen Yi has been described as “a shining example of the younger generation coming through – he likes legal issues, thinks hard about the cases he has, approaches them carefully and won’t rush off on something just to make an impact” (Chambers Global 2010). Considered “a formidable opponent in corporate disputes” (Asialaw Profiles 2013) with a reputation for “imaginative strategy” and “excellent cross-examination” (Legal 500 2015), Shen Yi believes in fighting hard but fighting honourably, and “receives praise from commentators and clients for his advocacy skills: “In Court, he doesn’t flinch from a tough fight, but at the same time he is not abrasive” (Chambers Global 2011). As a “vastly experienced senior counsel” (Legal 500 2017), he has consistently been cited as a “Leading Individual-Dispute Resolution” in Singapore by both Chambers Global and Chambers Asia. |
About the Moderator:
Mr. Chan Leng Sun SC is Baker & McKenzie’s Global Head of International Arbitration. He is qualified in Malaysia, Singapore and England. Leng Sun was appointed Senior Counsel in January 2011. Apart from being counsel, Leng Sun is a Chartered Arbitrator and is also on the panel of leading arbitral institutions. Leng Sun is President of the Singapore Institute of Arbitrators (SIArb). He is a member of the Committee on the Singapore International Commercial Court. Leng Sun was a legal officer of the United Nations Compensation Commission in Geneva and a SIAC-CIAC Observer to the UNCITRAL Working Group on Arbitration. He is the author of the book Singapore Law on Arbitral Awards and Co-Editor of Conflict of Laws in Arbitration. |
