[IN-PERSON] SIArb Masterclass Series: Arbitration Advocacy - Effective Opening and Closing Submissions

Join us to learn more about “Arbitration Advocacy - Effective Opening and Closing Submissions”.

SIArb’s Masterclass series focuses on the key skills of an arbitration practitioner and the core elements of the arbitral process. Opening and closing submissions fall right into the heart of both categories. Join this seminar to hear from two leading commercial barristers, Stephen Moriarty KC and Anneliese Day KC, discuss the art of effective written and oral submissions, from the perspective of both advocate and arbitrator.

During the seminar, Stephen and Anneliese will address, in turn, written opening submissions, oral openings, and closing submissions (written and oral). They will analyse what an advocate should be seeking to achieve at each different stage, how each stage differs from the others, and how to make them all work together to achieve your overall objective: persuading the tribunal of your client’s case. Along the way, they will talk about the differences and similarities between advocacy in court and arbitration, finding the right balance between law and fact, techniques for dealing with complexity or weaknesses in your case, and the pros and cons of closing in writing or orally. They will also share their experience of sitting on the other side of the table: what can arbitrators do to ensure they receive submissions that are helpful to them in form and content? For example, should arbitrators be prescriptive about the matters the parties should address; what is a reasonable page limit; and how can arbitrators ask effective questions during oral submissions? Just as importantly: how can the arbitrator use and critically analyse the submissions to decide the case?

The seminar will conclude with an opportunity for the audience to pose questions to Stephen and Anneliese, followed by networking drinks.
