SIArb and SCMA are pleased to present the Maritime Arbitrator Accreditation Programme (MAAP) as a standalone course suitable for current and aspiring maritime arbitrators who already have a sound understanding of the fundamentals of the law and practice of arbitration.

MAAP will be held in-person on 14 October 2022 and consists of 2 workshops and a Written Assessment.

  1. Module 1: The Legal Framework: Litigation & Maritime Arbitration – 2.5 hours
    This module will cover an overview of maritime arbitration and issues specific to maritime arbitration, in particular, a discussion on various ADR solutions (costs and time frames), litigation (why it is less suited to commercial parties), and arbitration (advantages and disadvantages of arbitration in a maritime context, fundamental features of maritime arbitration and others).
  2. Module 2: The SCMA Framework – 2.5 hours
    This module will cover the SCMA framework for maritime arbitration and will include the SCMA Model Arbitration Clauses, the Expedited Claims Procedure, the Expedited Arbitral Determination of Collision Claims (SEADOCC), managing arbitration and legal costs, and managing the arbitration procedure.

To complete the MAAP successfully, a candidate must:

(a) Achieve 100% attendance at the lectures; and

(b) Pass the MAAP Written Assessment.

Graduated from University of Singapore, Faculty of Law in 1977. Admitted to the Bar in January 1978. In practice for 42 years during which has had the opportunity to handle disputes of all manner including shareholders’ disputes, disputes relating to joint ventures, commodity contract disputes, international disputes relating to the sale of large-scale industrial machinery, infrastructure disputes, disputes involving company charges and mortgages, and shipping and maritime disputes.

Founder and previously Senior Partner of Gurbani & Co. a commercial law practice in Singapore.

Presently practicing as Arbitrator, Mediator and Counsel in Maxwell Chambers Suites, Singapore.

Consistently named as one of the leading practitioners in Singapore for Shipping/Maritime by Chambers, Who’s Who Legal (Shipping and Maritime) and other legal directories.

Named by Chambers as Senior Statesman in Shipping Litigation, Singapore

Mr. Andrew Moran KC

Resident, The Arbitration Chambers

Mr. Andrew G Moran KC is an independent, full-time, international commercial arbitrator, with nearly 30 years’ experience as arbitrator and judge, in the determination of an extremely wide range of commercial and maritime disputes. His primary office and base is at The Arbitration Chambers of Singapore in Maxwell Chambers. He was in practice for over 40 years as Counsel. He was appointed Queen’s Counsel 27 years ago and in that role he led teams of lawyers in conducting many complex commercial, civil and maritime cases. He is a Master of the Bench of the Honourable Society of Gray’s Inn.

Andrew has conducted and holds numerous appointments in arbitrations seated in jurisdictions including Singapore, England and Wales, Switzerland, Hong Kong, Malaysia, Australia, India, Pakistan and UAE, as sole arbitrator, presiding arbitrator and party appointed arbitrator. These concern all manner of commercial disputes subject to different governing laws – of both common and civil law systems.

He is a Fellow of the Chartered Institute of Arbitrators, a Fellow of the Singapore Institute of Arbitrators, and a Fellow of the Hong Kong Institute of Arbitrators. He is a panel arbitrator at the Singapore International Arbitration Centre, the Singapore Chamber of Maritime Arbitration, the Hong Kong International Arbitration Centre, The Korean Commercial Arbitration Board and the Asian Centre for International Arbitration in Malaysia.

He is a member of the London Court of International Arbitration Users’ Council and a supporting member of the London Maritime Arbitrators’ Association. He a member of the Worshipful Company of Arbitrators and a Freeman of the City of London. He has conducted numerous arbitrations proceeding under the rules of all major arbitration institutions and associations, including under SIAC, ICC, UNCITRAL, HKIAC, LCIA, SCMA, LMAA and other Rules and Terms.

In addition to his practice as arbitrator and counsel, Andrew was concurrently a part-time judge in England and Wales, for over 25 years, including sitting as a Deputy High Court Judge in commercial, construction, administrative, civil and chancery cases. He still sits at first instance in the High Court and as an occasional Judge of Appeal in the Isle of Man.

ASSESSMENTS

The MAAP Written Assessment is an open-book examination which will be conducted virtually on SIArb’s online course portal and/or on its Zoom meeting platform on 17 October 2022, 10.00am - 12.30pm.  Each candidate is required to sit for and pass this Written Assessment.

CERTIFICATE(S) GRANTED UPON SUCCESSFUL COMPLETION

A candidate who successfully completes only MAAP will be awarded the SIArb-SCMA “Certificate of Completion of the Maritime Arbitrator Accreditation Programme”.
