As the festive season approaches, SIArb’s CPD programme for 2021 ends by focusing on the starting point for any arbitration: the arbitration clause. This seminar will examine lessons to be learned from recent case law and practice for the drafting and interpretation of arbitration clauses, including a discussion of the problems currently crossing the desks of arbitral institutions and parties’ legal advisers. Our well-known panel will draw on their experience as counsel, as arbitrator and in roles at arbitral institutions to discuss, amongst other issues:
- misnaming arbitral institutions and other common ambiguities and errors;
- how to assess whether arbitration clauses are “compatible” - a common requirement under institutional rules for the consolidation of arbitrations arising from different agreements;
- disputes as to the scope of an arbitration clause, including overlapping and conflicting dispute resolution clauses, non-contractual claims, and statutory rights; and
- objections based on failure to comply with pre-arbitral steps in multi-tiered clauses: what issues are being raised and how do different institutions deal with them?
Webinar participants will be able to watch and listen to (via computer audio or telephone line) the video presentation and Q&A discussion on their screens, receive a PDF copy of the presentation slides, as well as participate in the Q&A discussion by sending in their questions to the moderator via text using the built-in Q&A function.

About the Speakers

Mr. Kevin Nash is the Registrar & Centre Director of the Singapore International Arbitration Centre. Over the past decade, Kevin has overseen the administration of thousands of international cases under all versions of the SIAC Rules and the UNCITRAL Rules.
Kevin is a member of the Singapore delegation at UNCITRAL Working Group II and represents SIAC at UNCITRAL Working Group III. He is listed by Who’s Who Legal as one of the leading arbitration lawyers in Southeast Asia and a ‘Future Leader’ in the Global Guide. Kevin is qualified as a barrister and solicitor with the Law Society of Upper Canada. |

Ms. Jelita Pandjaitan leads the Linklaters’ Dispute Resolution practice in Asia, focusing on South East Asia and Hong Kong SAR, where she practised for 10 years before relocating to Singapore. She advises and represents clients on their most complex cross-border commercial disputes, whether seeking resolution through arbitration, litigation, mediation or negotiation.
Jelita specialises in financial and energy and resource arbitrations, using all the major institutions and rules (such as SIAC, HKIAC, ICC, and UNCITRAL), including obtaining interim injunctive relief and enforcing arbitral awards in regional courts. She has been appointed by both the SIAC and the ICC as a sole or co-arbitrator. |
About the Moderator

Ms. Chiann Bao is an international arbitrator with Arbitration Chambers.
She currently serves as a Vice Chair of the IBA Arbitration Committee. She is also a Vice President of the ICC Court of Arbitration as well as the chair of the ICC Commission’s Task Force on ADR and Arbitration. From 2010-2016, Chiann served as the Secretary-General of the HKIAC. She is an honorary senior fellow at the British Institute of International and Comparative Law, a fellow of the Chartered Institute of Arbitrators, and a CEDR-accredited mediator.
