Obtaining an arbitral award may be the end of an arbitration, but can often be the start of a new process: enforcing and executing the award. In this webinar we have assembled a diverse panel of lawyers, a financial investigator and a disputes funder to provide a guide to enforcement in Asia’s two great powers (and two of the largest users of Singapore arbitration): China and India. They will explain not only the legal regimes applicable in each country, but look at the practicalities of enforcement, including how to identify assets in the first place and the use of third party funding to assist in the process.

About the Speakers
Mr. Vyapak Desai heads the International Dispute Resolution and Investigation Practice at the international law firm, Nishith Desai Associates.Vyapak's experience includes representing clients as Counsel in a host of complex litigation and arbitration cases including investment treaty arbitrations, commercial disputes. He is also a trained mediator/conciliator and acts as Arbitrator across international jurisdictions. Vyapak is the Co-chair, Council of MCIA, Director- CIArb India Branch, Convener - Indian Arbitration Forum (IAF), Member - ICC India Group, Member- AIAC Advisory Council, Malaysia, Advisory Board -MARC, Mauritius, Member of IBA, IPBA and the Bar Council of Maharashtra & Goa. Mr. David Gu is qualified to practice law in China and New York state, USA. He is a partner of Beijing office of TianTong Law Firm and specialises in international arbitration and cross border disputes. In the past 13 years, Mr Gu has represented Chinese and foreign companies in international arbitration proceedings under the Rules of ICC, SIAC, HKIAC, LCIA, SCC, SCAI, CIETAC and BAC, etc. He has also represented international companies to obtain mainland Chinese court orders for interim measures and enforcement of foreign arbitral awards and court judgments

Mr. Michael Harrington is the Managing Director of the Mintz Group’s Mumbai office, and he oversees the firm’s activities in South Asia. He has been a corporate investigator for more than a decade and specializes in cross-border intelligence and fact-gathering for sensitive pre-transactional and dispute-related investigations. Michael has managed hundreds of matters around the globe and conducted fieldwork in a dozen countries across Asia while based in the firm’s Mumbai and Hong Kong offices. |

Ms. Olivia de Patoul is Senior Legal Counsel ofDeminor Recovery Services.After spending almost eight years in the M&A department of an international law firm in Belgium, Olivia joined Deminor and is in charge of developing Deminor’s activities in the Asia-Pacific region. She opened the Hong Kong office in 2018. As litigation funder, Deminor assists clients by funding their litigation from an early stage up to recovery. Olivia is also part of Deminor’s enforcement desk, which focuses on assisting clients to obtain a successful recovery after having a final positive decision from a local court or arbitration tribunal. Olivia is a member of several local associations and frequently organises seminars related to litigation funding in Asia. |
About the Chairperson
Mr. Dinesh Dhillon is the Co-Head of the Allen & Gledhill’s International Arbitration practice. He has acted as lead counsel in international arbitration for global multinational corporations in the telecommunications, airline, hotel, commodities, construction, manufacturing and projects industries. He has also represented sovereign states in international arbitration cases. He has represented clients in landmark cases before the Singapore courts relating to jurisdiction of arbitral tribunals, challenges to arbitration awards and attempts to resist enforcement of foreign arbitration awards. Dinesh has represented multinational companies in cases before the Singapore International Commercial Court (SICC), Singapore High Court and Court of Appeal. Dinesh is the President of The Singapore Institute of Arbitrators, Fellow of the Asian Institute of Alternative Dispute Resolution, Board member of the Law Society’s Pro Bono Services Office, Treasurer of the Asia Pacific Forum of the International Bar Association and Co-Chair of the Legal & IPR Committee of The American Chamber of Commerce in Singapore (AmCham).
