About the Seminar:
In this seminar, Prof Lucy Reed reprises her 2012 Kaplan Lecture exploring the “softer” aspects of arbitrator decision-making, as relevant to counsel decision-making on case strategy.
The first part of the seminar will describe research on the process of decision-making in arbitration, which borrows from studies of judicial decision-making. This involves the balance between intuition and deduction, and the positive and negative impact on decision-making of “heuristics” – the mental shortcuts we all take, for example the “anchoring effect” – and resulting cognitive biases.
The second part will focus on how counsel can use this research in strategizing how to present their clients’ cases more effectively in arbitration.

About the Speaker:

Professor Lucy Reed is Director of the NUS Centre for International Law and Professor, NUS Law Faculty. Lucy joined the NUS Law Faculty in 2016 after retiring from the international firm Freshfields, where she led the international arbitration group. She is active as an arbitrator, and is a Vice-President of SIAC and ICCA. Among other appointments, Lucy served as a Commissioner on the Eritrea-Ethiopia Claims Commission and Co-Director of the Claims Resolution Tribunal for Dormant Accounts in Switzerland. While with the US State Department’s Office of the Legal Adviser, she was the US Agent to the Iran-US Claims Tribunal. Lucy speaks and writes regularly on international arbitration topics, and one of her most-cited articles remains Practical Guidelines for Interviewing, Selecting and Challenging Party-Appointed Arbitrators in International Commercial Arbitration (with Doak Bishop, 14 Arb. Int’l (1998)).
 

About the Chairperson:

 francisgoh Mr. Francis Goh is an equity partner of Eversheds Harry Elias LLP. He is the head of the firm’s International Arbitration Practice and he also leads the firm’s Private Client practice. He graduated from the National University of Singapore in 1990 and has since been in active legal practice for 25 years. Francis is a fellow of the SIArb and currently serves on the SIArb Council. Francis is also a Principal Mediator with the Singapore Mediation Centre. His background in litigation and commercial disputes resolution gives Francis a distinct advantage in negotiations, advising on commercial contracts and corporate governance. Francis is well placed to guide companies and business owners to manage their risk, processes as well as business succession issues.
